Reorganisation Bill 2019: Central RTI Act 2005 toreplace JK RTI Act 2009

SRINAGAR, Sept 20: With the implementation of J&K Reorganisation Bill 2009, the central Right to Information Act, 2005 would now apply to the two new union territories of J&K and Ladakh that will be carved out and will replace J&K RTI Act 2005.
The Central Right to Information Act 2005 would pay way for non-residents citizen to fill an RTI application pertaining to the administration of the two news UTs. While as earlier in the Jammu and Kashmir RIT Act 2009, only the residents of the state were allowed to file petition belonging to state public authorities
The RTI ACT came into power in year 2005, but in Jammu and Kashmir the Act was repealed and replaced with J&K RTI Act 2009. Jammu and Kashmir RTI Act had a time bound of 60 to 120 days and was disposed by State Information Commission (SIC) but since the implementation of JK Reorganisation Act, which makes centre RTI Act applicable to the Union Territories of J&K there won't be any time limit. As the central RTI Act does not have any such time limit.
Other than that in Jammu and Kashmir RTI Act 2009, if the authority have found any Public Information Officer (PIO) not performing the duties properly, a reference could be made to the SIC which had the power to impose penalties on the officer. Such a provision does not exist in the central law. As per the official there are scores of cases being filed and all the application would be taken care under the Central RTI Act 2005 and will come under the jurisdiction of CIC.
An RTI activist said that from now, any person living in any part of the country would now be able to file information requests with the J&K government. And they can file a request with the Ladakh union territory also. He added, "Earlier, people who were not residents could not file an RTI in Jammu and Kashmir because the central Act barred it. The development now opens up Jammu and Kashmir and Ladakh for everybody".
