Man missing since 2018, HC directs DGP to constitute SIT | | | EARLY TIMES REPORT
JAMMU, Jan 8: In a petition filed by Anju Gupta, who claims that her husband is missing since September 2, 2018 and has approached the Police Station Udhampur, in this behalf immediately but could not get any response or action as warranted under law. Anju Gupta states that she also approached the DIG, Jammu, about the missing of her husband but no action was taken. Justice Ali Mohammad Magrey after hearing both the sides observed that prima facie it appears that Police has not taken any action which has constrained the petitioner to approach this Court to seek enforcement of her rights as guaranteed to her under the constitution of India and to seek the help of the respondents, as provided in terms of the law, to know about the whereabouts of her missing husband. Since the petitioner has approached the Court in terms of application under Article 226 of the constitution of India by filing this petition and Court will not also take it in a routine manner that may result in delaying any further progress in the matter. Justice Ali Mohammad Magrey directed Director General of Police, Union Territory of J&K, Jammu, to constitute a Special Investigating Team (SIT) comprising of the officers of the Police headed by an Officer not less than the rank of a Senior Superintendent of Police to ensure that the proceedings initiated on the compliant of the petitioner are taken to its logical conclusion. --JNF
