Execution of Decree: CJM directs AEE M&RE to file compliance report

JAMMU, Feb 6: The court of Chief Judicial Magistrate (CJM) Jammu today directed the AEE (Assistant Executive Engineer) electric Sub Division-II, JPDCL Gangyal/Shastri Nagar to file compliance report in execution decree titled Kulwant Singh vs Chief secretary and ors on next date of hearing on 6th March 2020.
When the matter came up for hearing, Decree holder counsel Mohammad Irfan drew the attention of the court towards the contemptuous attitude of the Judgment debtor no.2 who miserably failed to shift the electric poles and transformer from the residential house of the decree holder adding, counsel further submitted that on previous date counsel for judgement debtor has assured that on next date they would filed compliance report but today also they didn’t filed any compliance report and they are seeking time on one pretext or the other rather come what may judgment debtor no.2 has to implement the Court decree in its letter and spirit.
Counsel for the judgement debtor submitted that they are not getting any vacant space for shifting the transformer and apprised the court that AEE has moved a representation to Councilor Raj Rani of ward no 45 apprised her about the vacant space be required for shifting of above said transformer of 500 KV and electric poles and feeder manager namely Jagjeet Singh is personally present in the court and further submitted that decree is of year 2008 and now they are seeking execution of the decree.
Counsel for decree holder Mohammad Irfan rebutted the assertions of the Judgment debtor counsel no.2 that your honour we have not objected even in the year 2008 when the decree is in our favour rather the judgment debtor no.2 are not ready at that crucial juncture for shifting of the same and now just taking this plea to play safe so that this court cannot go tough against them.
After considering the rival submissions of both the counsels, CJM directed the AEE Electric Sub Division-II, JPDCL Gangyal/Shastri Nagar to file compliance report on next date of hearing on 6th march 2020.
