High Court issues notice to govt on PIL for ‘withholding’ release of Shikra movie | | | EARLY TIMES REPORT
SRINAGAR, Feb 6: The Jammu and Kashmir High Court on Thursday issued a day’s notice to centre and sought J&K’s Advocate General’s appearance tomorrow on a petition, seeking “withholding” the release of upcoming Hindi movie 'Shikara' which is based on the exodus of Kashmiri Pandits from the Valley in 1990. “In view of the averments made in the petition and the relief claimed, we feel that there is a real urgency involved in the matter and that the response of the official respondents should be obtained in the context of the interim relief prayed for (withholding release of the movie) by the petitioners,” said a Division Bench of Justices Ali Mohammad Magrey and Dhiraj Singh Thakur while hearing a Public Interest Litigation, filed by three Kashmir-based activists— Iftikhar Misgar, Majid Hyderi and Irfan Hafiz Lone. “Accordingly, we propose to post the matter tomorrow (Friday) in the morning session for having the response of the respondents, especially the official respondents,” the court said and accordingly asked Assistant Solicitor General of India, Tahir Majid Shamsi, on behalf of the centre and UT’s senior Additional Advocate General B A Dar, to take notice on behalf of official respondents. “Notice shall be served on the rest of the respondents by tomorrow,” the court said, adding, “Notice is also directed to be issued to the learned Advocate General for appearance before the Court tomorrow (February 7). The movie, directed by Vidhu Vinod Chopra, is scheduled to be released on Friday. The petitioners have alleged that the movie contains "communal content" and has “concocted portrayal of Kashmiri Muslims about the migration of Kashmir Pandits on January 19, 1990.” They have sought the withholding of the film’s release till it is “reviewed/scrutinized and censored by the appropriate authorities.” They have also sought directions to the respondents “to edit / remove the communal, inflammatory and frivolous content from the movie and to review the certificate issued with regard to the movie and censor the controversial and communal scenes / dialogues from it.” Besides, they have sought directions to “ensure that all possible steps are taken to prevent polarization and communalization of atmosphere in the country, particularly in Jammu and Kashmir.” “There are many reasons which led to the mass migration of Kashmiri Pandits; and difference of opinion between different stakeholders exists in this regard,” the petition reads. The perception, the petitioners said, is being built that the Kashmiri Muslims were responsible for the incidents, leading to the mass migration of Kashmiri Pandits from the Kashmir. “It can also be safely stated that the other Kashmiris including Kashmiri Muslims and Sikhs tried their best to prevent the Kashmiri Pandits from leaving the Valley,” they said, alleging that the renowned filmmaker Vidhu Vinod Chopra has produced and directed Hindi feature film Shikara showing “a shabby and cruel picture of local population, especially Muslims". The petitioners said that the portrayal of Muslims in the film is not only against the actual facts and events, but has also the tendency of hurting the sentiments of all Kashmiris. “The trailer of the movie clearly points towards the biased and communal content in the movie in question,” the petition said. |
