HC rejects bail in NDPS | | | EARLY TIMES REPORT
JAMMU, Sept 3: Justice Dhiraj Singh Thakur of J&K High Court rejected bail application Mohammad Sadiq from whose possession 4 grams heroine and Rs 5 lakh were recovered. Justice Dhiraj Singh Thakur while rejecting bail after hearing Adv Monish Chopra for the applicant whereas Deputy AG AM Malik for the UT observed that case diaries have been produced by the concerned police agency. Having gone through the same and considering the facts of the present case, which involves recovery of more than Rs 5 lakh along with the heroin from the applicant, it is difficult for this court to record a satisfaction that the applicant is not guilty of an offence under Section 27-A of the NDPS Act notwithstanding the fact that the quantity of Heroin allegedly recovered from the applicant is stated to be a small quantity. Justice DS Thakur further observed that this Court do not find any ground for releasing the applicant on bail. The instant bail application is, accordingly, dismissed along with connected application(s). It will be open for the applicant to approach the court below again after the presentation of the chargesheet and after the material witnesses are recorded.
