JKSLSA compensates rape victim

JAMMU, Sept 6: Jammu and Kashmir State Legal Services Authority (JKSLSA) provided compensation to a minor rape victim from Bhaderwah.
According to JKSLSA order no 152-SLSA (LS) of 2020, a compensation of around Rs 2.66 has been provided to the victim.
“Sanction is hereby accorded to the release of Rs 2,62,500, in favour of District Legal Services Authority (SLSA), Bhaderwah for further disbursement to the victim/claimant as interim compensation vide order Dated 21.08.2020 under FIR No 104/2019 Police Station Gandoh US 363/109/376 IPC & Section 4 of POCSO Act under the J&K Victim Compensation Scheme 2019 as recommended by Chairman DLSA Bhaderwah subject to the conditions that victim/claimant has not been compensated under any other scheme of the central or state government, any insurance company or any other institution before releasing the amount of compensation in favour of the victim/claimant. Victim/claimant shall file an undertaking before the disbursal of the compensation amount in terms of section 12 clause (1), (2), & (3) of J&K Victim Compensation Scheme 2019. DLSA Bhaderwah shall after due enquiry disburse compensation in accordance with provisions of J&K Victim Scheme, 2019 and the funds released would be utilized only for the above purpose. Grantee Authority shall maintain proper accounts and furnish the utilization certificate of the aforesaid funds”, order issued by M K Sharma, Member Secretary JKSLSA read.
Earlier, in a first of its kind instance, the Jammu and Kashmir High Court had permitted a rape victim from Doda district to terminate her pregnancy. A 17-year-old girl, who was 26 weeks pregnant, needed the court’s assent since law allows termination after 20 weeks only if the mother’s life is in danger.
Mohd Shakir Hussain, petitioner’s counsel said that the case is still going in the court and next hearing is scheduled on September 8, 2020.
