JAMMU, Apr 9: In a LPA filed by ex-Chief Minister Mehbooba Mufti against the judgment of Writ Court whereby Writ Court dismissed her petition seeking passport, a Division Bench of Jammu & Kashmir High Court comprising Justice Tashi Rabstan and Justice Javed Iqbal Wani after hearing Sr. Adv Jehangir Iqbal Ganai for Mehbooba Mufti, disposed of the petition by providing liberty to the appellant to approach the appropriate authority to avail the proper remedy available to her under the scheme.
DB further directed that on receipt of the appeal, the authority concerned shall consider and decide the same on its merits, strictly under rules, regulations and the provisions of the Act, that too uninfluenced by the observations made in the judgment impugned dated March 29, 2021. Needless to say that Court has not expressed any opinion on the merits of the case. (JNF) |
