Court rejects bail of Jail Supdtt’s driver, other in Nagar Singh house firing case

JAMMU, Apr 28: City Judge Jammu Manjeet Rai today rejected the bail applications of Kuldeep Kumar driver of Jail Superintendent Kot Bhalwal and Jasbir Singh alias Kaka who was arrested by the Gandhi Nagar Police in much publicized Nagar Singh house firing case. According to the police case that on 03.04.2021 at about 22.00 hours an information was received through PCR in the P/S Gandhi Nagar that some unidentified 5/6 masked persons travelling in 2/3 vehicles numbers not known fired on residential premises of one Nagar Singh S/O Koka Ram R/O H. No. 33 A/D Gandhi Nagar Jammu from outside of gate with firearms with intention to kill him. On the receipt of such information a case FIR No. 91/2021 offence under sections 307/120-B/149 IPC and 3/25 Arms Act registered in the P/S Gandhi Nagar and investigation started. It is further submitted in the report that Nagar Singh, Rakesh Singh, Jagar Singh and son of Nagar Singh and Royal Singh S/O Manjit Singh R/O Mohalla Dalpatian were tried in case FIR No. 247/2009 offences U/S 302, 120-B, 409, 204 RPC 3/25 Arms Act. The son of Nagar Singh died during trial and Nagar Singh , Rakesh Singh, Jagar Singh etc were acquitted in the said case, whereas said said Royal Singh was convicted and sentenced to life imprisonment. Royal Singh filed an application for grant of bail in High Court of J&K which was dismissed by High Court. Royal Singh feels that Nagar Singh wants him to remain behind bars. Royal Singh from Kote Bhalwal Central Jail in consultation and in conspiracy with his gang members wanted to kill Nagar Singh and others.
City Judge Jammu Manjeet Rai after hearing Additional Public Prosecutor Arvind Rathore for the It is further held that if the offence is of a kind in which bail should not be granted considering its seriousness the court should refuse the bail. In view of the above stated facts and circumstances and seriousness of the offences for the commission of which the accused has been arrested, I am satisfied that there is no prima facie case made out for granting of bail to the applicant/accused to set him at liberty. With these observations, the Court rejected the bail application. (JNF)
