Criminal appeal must be pending for 5 years or more to seek bail on grounds of delay: DB | | | Early Times Report
JAMMU, May 27: A Division Bench of Jammu & Kashmir High Court comprising Justice Dhiraj Singh Thakur and Justice Puneet Gupta while dismissing the bail application of a convict in murder case observed that a plea before the High Court seeking suspension of sentence and grant of bail on the ground of delay in conclusion of the trial or disposal of appeal in the case, can be entertained only if the criminal appeal has been pending for over five years. The bench observed that the order of conviction and sentence by the court below was passed on July 23, 2020 and the appeal against the same was filed on August 6, 2020. It is worthwhile to mention here that on July 23, 2020, 2nd Additional Sessions Judge Jammu V S Bhou awarded life-imprisonment to eight accused namely Romesh Singh, Tilak Raj, Suram Singh sons of Sat Pal residents of Dayaran Tehsil & District Jammu, Balwan Singh son of Saran Singh resident of Pakkhian Tehsil & District Jammu, Raghubir Singh son of Sardari Singh resident of Marjali Tehsil and District Jammu, Mangal Singh alias Manga son of Bhagat Singh resident of Gorkha Nagar Tehsil & District, Jammu, Manohar Lal alias Kala son of Devi Singh resident of Harkund Falora Tehsil & District Jammu and Tilak Raj alias Radhey son of Hans Raj Sharma resident of Kangrail Tehsil and District Jammu in murder case over land dispute. |
