Accused convicted in fraud case

JAMMU, Sept 28: The Additional Sessions Judge (Anti-Corruption) Jammu convicted an accused involved in a case of fraud and cheating.
The accused Rajinder Kumar @ Shinda, S/o Dewan Chand, R/o Vikas Nagar Talab Tillo, Jammu was booked in case FIR No 02/2007 U/S 420/467/468/471/120-B RPC, R/W section 5(2) PC Act Svt 2006 of Police Station Crime Branch, Jammu.
The brief facts of the case are that a written complaint was lodged by Mangat Ram S/o Chajju Ram R/o Chumbian Samba alleging therein that he purchased a bus bearing Registration No JKQ-5349 in October-1988, in partnership with one Kaka Ram. This business did not turn out to be profitable. As such, he sold that bus in June 1989 to a party hailing from UP and the Route Permit of the vehicle was deposited with RTO, Jammu.
In the year 1991, Rajinder Kumar @ Shinda approached him along with one Jai Singh @ Raja Dalal, for the purpose of obtaining the Route Permit, the deal was struck, and he was made to sign various forms and documents brought to him by the Rajinder. His passport size photograph was also taken by Rajinder, on the pretext of transfer of the route permit. But, after a gap of 13 years, he received a letter from J&K State Financial Corporation on 17.04.2004, whereby he was asked to pay an amount of Rs 15,49,495 on account of a loan for Vehicle No JK02B-2174, registered in his name which he had never purchased or owned. On this instant case was registered in PS Crime Branch, Jammu.
After completion of investigation, the charge sheet in the instant case was produced in the Court of Law on 23.04.2013 against the accused Rajinder Kumar @ Shinda, Tarseem Lal, son of Sain Dass, resident of Aalla Tehsil Bishnah Jammu, Subash Chander Chopra, son of Des Raj, resident of Channi Himmat Jammu the then Chief Manger SFC Jammu (now retired), Rajinder Prasad, son of Bua Ditta, resident of 22/C Extension Gandhi Nagar, Jammu the then Manager Transport Section SFC, Jammu (now retired/dead), Sudershan Kumar Bali, son of Late Dilbagh Raj, resident of 116-A Gandhi Nagar, Jammu, the then Assistant Manager Transport Section SFC, Jammu (now retired) and Mool Raj Sharma, son of Krishan Chand, resident of 30/11 Nanak Nagar, Jammu, the then Senior Assistant SFC, Jammu (now retired). The Special Public Prosecutor of Addl Sessions Judge Anti-Corruption Court, Jammu contested the case vigorously as a result of which one of the accused Rajinder Kumar has been convicted for simple imprisonment of 3 years each for the commission of the offences U/S 420/468 RPC and for a term of five years each for offences U/S 467/471 RPC and shall also pay a cumulative fine of Rs one lakh for all the offences.
