CJM rejects bail of fraudster who duped 1.3 crores for MD Seats

JAMMU, Jan 18: Chief Judicial Magistrate Jammu Amarjeet Singh Langeh today rejected bail application of Fayaz Ahmed Rather who duped 1.30 crores for arranging admission in MD Course at ASCOMS Sidhra.
According to the Crime Branch a petitioner assured complainant in the case for arranging admission of his son in MD Course at ASCOMS Sidhra for 2016 for which he demanded an amount of Rs. 1,30,00,000; that complainant paid said amount to petitioner; that petitioner failed to fulfill his promise and thereby cheated complainant with dishonest, mala-fide and fraudulent intention; that petitioner resultantly, is involved in FIR 10 of 2021 for offences under sections 420/120-B RPC; that offences committed by petitioner are anti-social, heinous and non-bailable in nature; that petitioner is also involved in another FIR 18 of 2020 for offence under section 420 IPC registered with Police Station Kothi Bagh, Srinagar having the same pattern of duping people; that investigation of the case is at preliminary stage and release of petitioner on bail at this stage would impede the same; that grant of bail to petitioner will encourage him to re-indulge in similar activities etc. Ultimately, rejection of this application has been solicited.
The CJM Jammu while rejecting bail application observed that the nature of accusation against petitioner, character of evidence collected by investigating agency thus far, gravity and enormity of seriousness of offences involved in the case, initial stage of investigation and impact of grant of bail on public at large, no case for grant of bail is made out by petitioner at this stage.
The CJM Jammu observed that it is also needs to be pointed out that revelations in the investigation only underline that investigating agency sets its energy more stringently on expediting the investigation by focusing on such vital aspects which have till date been glaringly left un-adhered.
Only such approach will bring true and further facts to fore.
