CBI Court rejects bail plea of Patwari, JE, AGE in trap case | | | Early Times Report JAMMU, Feb 14: Special Judge Anti-Corruption CBI Cases J&K R K Wattal while disposing of different applications dismissed the bail applications of Patwari, Junior Engineer and Assistant Garrison Engineers in trap case. According to CBI that in that case FIR No RC0042022A0002 dated 15.01.2022 has been registered by the CBI, ACB, Jammu u/s 7 of PC Act, 1988 on the basis of complaint dated 13.01.2022 lodged by Harbinder Pal Singh R/o Kotli Arjun Singh, R S Pura, Jammu, alleging demand of bribe of Rs. 50,000 by the accused Ashok Kumar, Patwari, Patwar Halqa Jassore, R S Pura for issuing fard in respect of land owned by his father. The verification of complaint was carried out wherein demand of bribe by the accused from the complainant was confirmed. Accordingly, case RC0042022A0002 was registered on 15-1-2022 u/s 7 of PC Act, 1988 against the accused. A trap was laid down and the accused was caught red handed while demanding and accepting bribe of Rs. 35,000 from the complainant in the presence of independent witnesses. While rejecting the bail application of Ashok, Special Judge CBI observed that when there are possibilities that accused will use his influence in shutting the mouth of person who are likely to depose against him in investigation for further disclosures in support of crime and further revelation by witnesses. The stage of investigation or trial is also the important aspect which cannot be given go by while considering the bail only on the premises that the accused is behind the bars for three to four weeks. As per the prosecution the witnesses, verifying officials are yet to be examined and the persons in the organisation of the accused acquainted with facts relating to crime are yet to be recorded besides some more documents are required to be collected the accused in case released on bail may use his connections and influence which may hamper the remaining investigation and compel the witnesses not to depose against him. These circumstances have to be weighed while considering bail in trap cases. In another case as per CBI that the case FIR No. RC0042022A0001 dated 6-1-2022 has been registered by the CBI, ACB, Jammu u/s 120-B of IPC r/w section 7 of PC Act, 1988 on the basis of complaint dated 5-1-2022 lodged by Sameer Ajrawat R/o 208 Sector-4,Channi Himmat, Jammu, alleging demand of bribe of Rs. 25,000/- by the accused Mahesh Chandra Gangwar, JE and Mohammad Imranullah, Assistant Garrison Engineer, (AGE) both officials of GE, MES, Satwari, Jammu for issuance of completion certificate for processing of pending bills for the work which had been allotted to him under a contract. That the verification of complaint was carried out according to which demand of bribe from the complainant, by both the accused persons, was confirmed. Accordingly, a case RC0042022A0001 was registered on 6-1-2022 u/s 120-B of IPC r/w section 7 of PC Act, 1988 against the accused. On 7-1-2022, a trap was laid and both the accused persons were caught red- handed while demanding and accepting bribe of Rs. 10,000/- each from the complainant. Both the accused were arrested and taken into custody as per procedure established by law. While rejecting the bail applications Special Judge CBI observed that bail cannot be construed in routine manner. Corruption is a menace in the society and like a termite which hollows a society from within. It is the one of the biggest road blocks in the development and progress of society and the nation. It is true that often in a system sometimes the biggest crocodiles escape with impunity and small fries are entrapped. |
