Bail plea of Gola Shah rejected | | | Early Times Report
JAMMU, May 25: City Judge Jammu Manjeet Rai today rejected the bail application of Ravinder Gupta @ Gola Shah. According to the police case on 18-5-2022, Kamal Nabh Sharma submitted an application that he is resident of Peer Mitha Jammu and wants to bring into his notice that the above mentioned person namely Ravinder Gupta had illegally/forcibly taken possession of land situated at Greater Kailash Sunjwan Jammu. He submitted that he had purchased a piece of land measuring 15-1/2 marlas classified as Ghairmumkin Khad from attorney holder Abdul Majeed falling under khasra No.549 Min which was registered in his name in the court of law and mutation of the same has been made in revenue records also. During his service period he had constructed a boundary wall over his plot but due to his service at different places of the state he could not construct house there. Now after retirement from his service when he visited his plot at Greater Kailash, to his surprise he found that his land has been illegally encroached and occupied by one notorious land grabber Gola Shah. He has taken his land in the boundary wall of his house. He had approached the Assistant Commissioner revenue on 12-5-2015, who marked the application to the then Tehsildar Bahu to take necessary action and to clear the land encroachment. The then Tehsildar got report from Patwari Halqa who furnished his report in his favour on the basis of revenue records. Since then he was requesting Shah to vacate his plot/land but time and again he is playing delaying tactics. Last month he visited him at his house in Greater Kailash Jammu where he abused and threatened him of dire consequences if he continues to pursue to get his land/plot vacated. Moreover, he claimed that his land/plot encroached by Shah actually belongs to him as per land papers in his possession. He gave a copy of these papers to him. Since revenue department has given report in his favour therefore it is clear that these papers are totally fake and forged by Shah with the intention to grab the land which actually belongs to him. On the receipt of said application, FIR 53/2022 registered in the police station, Gangyal for the commission of offences under sections 420, 467, 468, 504, 506 IPC and investigation started. The IO visited the spot of occurrence and prepared the site plan thereof, recorded the statement of complainant under section 161 Cr.P.C. and on the basis the statement, the offence under section 379 IPC was added. Shah was arrested in the case and during investigation the offence under sections 379, 504, 506 IPC stands well established against accused, whereas, the investigation is continuing for offences under sections 420, 467, 468. City Judge Jammu observed that the accused is allegedly involved in the commission of offences under sections 379, 420, 467, 468, 504, 506 IPC and the offences under section 379,420,467,468 IPC are non-bailable and serious in nature, as such, the accused cannot claim bail as a matter of right. Moreover, it would be premature to comment on the evidence collected till date as the investigation of the case is at its initial stage. In view of the serious nature of allegations and the involvement of the accused in various FIRs and the accused is a history sheeter, enlargement of accused on bail, would not only cause the impediment and obstacle in the completion of investigation but also shatter the confidence of the complainant. The accused does not deserve any leniency in grant of bail. |
