Hunzar cloudburst: After HC intervention, Govt declares 18 missing persons dead | | | Asif Iqbal Naik

Jammu, Apr 5: After significant order issued by the Jammu & Kashmir And Ladakh High Court directing the government to issue death certificates in favour of the 18 missing Hounzer Dachhan Cloudburst victims as dead, Deputy Commissioner Kishtwar has issued a detailed order declaring all the missing victims as dead beside also directed the officials to speed up the compensation cases in favour of the kith and kin of the victims. He set one month deadline for completion of the process including issuance of death certificates of the 18 missing persons. As per the details available with Early Times, during the intervening nights of 27/28.07.2021, incidents of cloudbursts resulting into flash flood was reported from Hunzar Area of Dachhan Tehsil, resulting into loss of life and property. Twenty six persons went missing out of which 8 bodies have been recovered so far, whereas 18 are still missing and accordingly the procedure for declaring the missing 18 as death was processed including lodging of missing report in the concerned Police station, copy of police report, copy of Roznamchas of concerned PH (Loharna)report of field staff,. statement of family members, statement of prominent persons including Sarpanch / Naib Sarpanch Loharna B and resolution of general public of hamlet Hunzar, general information of public and receiving information / objections about whereabouts of the missing persons within a period of 30 days from the date of publication. The legal opinion further suggests that from the perusal of record, it transpires that all the formalities have been complied with and no objection whatsoever have been received from any quarter regarding the death of missing persons, moreover, police in its report has categorically mentioned that the persons who are reportedly missing have been died in the said incident. It can also be inferred from the chain of circumstances that there is not an iota of doubt that the eventuality has resulted in death of these persons and there is no likelihood that their bodies can be traced later on, therefore, there is no harm in issuing death certificates to their next of kin and there is no legal impediment in extending the benefits to families of the deceased persons. “Accordingly in view of the above and as per the directions received from the Govt ( FC J&K Govt), it is hereby ordered that Registrar Death and Birth as per S.0 494,495,496,497,498,499, 500 and 501 Dt:- 10.10.2022 issued by the planning Dev and Monitoring Dept shall implement the directions of the Govt immediately. He shall submit the death certificates of the persons missing/ presumed dead as per the enquiry report conducted by the SDM Marwah vide no. SDM/ M/ GEN/ CAMP/K/ 536-38 Dt:- 30.10.2021 to this office by or before a month time positively so that relief benefits are disbursed among the rightful claimants immediately as per the directions” read order NO: DCK/R/2022-23/ 1798-1803 issued by DC Kishtwar declaring Honzar cloudburst victims as dead. |
