Fake appointment case: Court rejects bail application of Sarpanch

Jammu, Apr 8: Railway Magistrate Jammu RK Lalhal on Saturday rejected the bail application of one Abdul Qayoom Khan who is presently Sarpanch of Mandi Poonch in a fake appointment case.
The Court observed that perusal of the CD file reveals that instant FIR got registered on 13.03.2023 on the behest of a letter No. 01/SS/JAT/023 dated 13.03.2023. The main allegations as alleged in the complaint are that on 13.03.2023, a person telling his name as Abdul Qayoom Panchayat member from Sidhra entered the office of complainant along with three other persons and produced an appointment letter from the office of Divisional Railway Manager New Delhi which is a fake appointment letter. The said three persons left his office immediately on hearing that the letter is fake. Upon which FIR no. 07/2023 for the offence/s punishable under sections 420/467/468 IPC was registered.
During the course of investigation, I/O seized the posting orders, recorded the statement of witnesses (victim) under section 161 Cr PC. The main allegations are that accused has grabbed Rs 2.5 lakhs from Sher Khan, Rs 1.5 lakh from Daud Khan, 3 lakhs from Suleman Khan, Rs 3,80,000/- from Shahid Khan and Rs 3,50,000/- from Tanveer Ahmed Khan, as such, total Rs amounting to Rs 13,80,000/- and has issued fake appointment orders. Investigation is still going on.
Railway Magistrate Jammu RK Lalhal after hearing both the sides observed that keeping into consideration the nature of the offence/s, maximum punishment prescribed for the alleged offence/s, stage of investigation and law laid down supra, I am of the considered opinion that prima facie case is not made out in favour of accused admitting him on bail at this stage and in case bail is granted, people will lose faith in the judicial system and it is against the larger interest of the society as well. Accordingly, the court is not inclined to grant bail to the accused. Accordingly, bail application stands rejected. (JNF)
