Srinagar acid attack case: Court awards life sentence to convicts, imposes Rs 5 lakh fine | | | Early Times Report
Jammu, Aug 22: Principal Sessions Judge Srinagar, Jawad Ahmed, has delivered a verdict in a high-profile acid attack case, sentencing Irshad Amin Wani and Umer Noor to life imprisonment and a fine of Rs 5 lakh. During the sentencing, Principal Sessions Judge Srinagar Jawad Ahmed heard arguments from Special Public Prosecutor Abdul Aziz Teeli, as well as advocates Malik Ahmed and Yawar Khan representing the accused. The court acknowledged the potential for rehabilitation and personal growth of the young convicts. However, it stressed the irreversible damage they inflicted upon the victim. The scars, both physical and psychological, left on the victim’s face and psyche will forever remind her of the brutal act, altering the course of her life. Considering the magnitude of loss and trauma suffered by the victim and the impact of the disfiguration caused by the corrosive substance used by the convicts, the court found that the convicts do not deserve leniency. The court emphasized that the tangible suffering and lifelong emotional trauma endured by the victim far outweigh any hypothetical chance of rehabilitation for the convicts. The court further noted that individuals capable of such harmful and hateful actions, driven by trivial matters like envy and jealousy, cannot be trusted to reintegrate into society. The convicts were sentenced to 10 years of imprisonment and a fine of Rs 25,000 each for the offense under Section 120-B RPC (criminal conspiracy), with further imprisonment of one year in default of fine payment. For the offense under Section 326-A RPC (acid attack) read with Section 120-B RPC, the convicts were sentenced to life imprisonment and a fine of Rs 5 lakhs each. The execution of this sentence is subject to confirmation by the Hon’ble High Court as per Section 376 CrPC Svt, 1989. The court recommended awarding the maximum compensation to the victim under the J&K Victim Compensation Scheme, 2019. The court ordered the entire case record to be submitted to the High Court for confirmation of the life imprisonment sentence. The convicts were informed of their right to appeal against the judgment and sentence. A copy of the judgment and sentence order will be provided to them free of cost. This verdict highlights the court’s stance on severe consequences for such heinous acts and its commitment to delivering justice to victims of such crimes. |
