Early Times Report Jammu, Jan 22: Special Judge CBI Bala Jyoti today framed charges against Farooq Khan then DC Doda and two others in fake gun license scam. According to the details available with Early Times the present case was registered in pursuance to Notification dated 05.10.2018 under section 5 of DSPE Act 1946 issued by Ministry of 'Personnel Public Grievances' and Pensions (Department of Personnel and Training) Govt of India New Delhi with the consent of State of J&K Home Department vide Notification No.228-41-2018 ABD-11 for transfer of FIR No.ll of 2018 dated 17.05.2018 of Police Station Vigilance Organization Jammu. Allegedly during the period of 2012-2016, Deputy Commissioner of various districts including Deputy Commissioner, Doda in-connivance with private person and others fraudulently and illegally issued the gun licences. They allegedly ignored Arms Procedures and Rules governing the subject for mandatory consideration by abusing their official position as Public servant and thereby such acts constitute the commission of criminal mis-conduct by them under section 5 of sub section (2) of PC Act Svt. 2006 r/w section 3/25 Arms Act, 1962 and consequently an FIR bearing No.11/2018 was registered in Police Station Vigilance Organization Jammu. According to prosecution, accused No. 1 Farooq Ahmed Khan during his posting, as District Magistrate Doda issued more than 12,000 Licences w.e.f 01,06.2010-24.04.2013 and out of the 15 instances Special Judge CBI Bala Jyoti after hearing both the sides observed that, prima facie it appears that offences under section 120-B r/w 420 RPC and u/s 5(1) and r/w 5(2) of PC Act Svt. 2006 are made out, hence they are charge sheeted for commission of offences under sections 120-B r/w 420 RPC and u/s 5(1) and r/w 5(2) of PC Act Svt. 2006 as such. .r.t issuance of Arms Licences, four chargesheets have been filed against the Farooq Ahmed Khan and ors. Similarly, accused Parmodh Kumar Sharma of M/s. 'Nav Durga Gun House' is implicated in this charge sheet appears to be a principal conspirator. According to prosecution, principal conspirator Parmodh Kumar Sharma has visited the unit of LD Umesh No,67 Bn at 'Shillong' in 2013 in unit 149-Bn w.e.f 2009-Dec 2012 meet LD Umesh, the then Assistant Commandant CRPF in the year 2009-Dec-2012 and it is Parmodh Kumar Sharma who apprised Umesh regarding issuance of gun licences 'J & K' and misrepresented about the eligibility of 'issuance of arms' licences against the prevalent procedure, thereafter he provided application form to, ID Umesh and asked him to file the same in back date and finally LD Umesh furnished the duly filled application form to Parmodh Kumar Sharma and gave Rs, 7000/- as illegal gratification for issuance of arms licences. Special Judge CBI Bala Joyti after hearing both the sides observed that , prima facie it appears that offences under section 120-B r/w 420 RPC and u/s 5(1) and r/w 5(2) of PC Act Svt. 2006 are made out, hence they are charge sheeted for commission of offences under sections 120-B r/w 420 RPC and u/s 5(1) and r/w 5(2) of PC Act Svt. 2006 as such, they are accordingly charge-sheeted separately for the commission of aforesaid offences, the contents of the charges are read over and explained to the accused persons separately. |
