Ramban, Sept 21: District Magistrate Ramban Mohammad Aijaz today initiated criminal proceedings against the construction company-Ramki Group for not undertaking the four lane work from Km 187.300 to 189.600 and maintenance work of existing National High way in Banihal Town as a result of which general public was put to inconvenience. A notice under sanction 133 of Cr Pc has also been served upon the construction company.
The construction company was awarded the rate contract in 2011 for taking up four lane work in the Bahihal areas besides being entrusted upon the responsibility of maintaining the existing national highway in the Banihal town which is also one of the prerequisite of contract agreement signed by the company with Government. But after passing a tenure of 5 to 6 years, the company did not start the works.
The District Magistrate Ramban convened series of meetings with the construction companies from April to September 2016 wherein commitment was shown every time for initiating both four lane and maintenance works by the Ramki Group but in actual practice nothing was recorded on ground till date unlike other construction companies which are constantly working on their allotted works on the national high way day and night.
Collector Land Acquisition, NH1A (ADC Ramban) has also reported about delay caused by the Ramki Group in starting the works of Four lane and maintenance of existing highway from Km 187.300 to 189.600 which was ought to be done pursuant to conditions of the four lane contract.
The District Magistrate mentioned in his order that non-commencement of National Highway work by the Ramky Group will turn out a bottleneck vis-a-vis other construction companies engaged on the highway for culminating the work of prestigious highways project in time bound manner.
Proclaiming the working approach of the company total insensitive towards execution, maintenance and repairing of the national highway which in turn has resulted in public nuisance, District Magistrate Ramban with the powers vested upon him under section 133 of Criminal Procedure Code (CrPc) has initiated criminal proceedings and instructed the construction company for taking up both four lane and mentainence works within a period of 10 days.
Further the company has been instructed to show cause before the District Magistrate on 30-09-2016 at 11.am after that further action as per the CrPc shall be taken against the company for blatant disregard of contract agreement and its maintenance clause and thereafter in case of non-compliance, the order shall be made absolute to attract further action under section 188 of Ranbir Penal Code (RPC).
