HC directs CS, rev secy to file status report suggesting mechanism for removing encroachments | Encroachment of 20 lakh kanals of state land | | Early Times Report Jammu, Sept 21: A high court division bench of first puisne judge, Justice Ramalingam Sudhakar and Justice B S Walia, in a PIL highlighting encroachment of state land by the powerful land mafia today directed the chief secretary and revenue secretary to file a status report, suggesting mechanism for removing encroachments and restoring the encroached land to its original status. When this PIL came up for hearing, the petitioner's counsel submitted that there was a complete non-serious attitude of the state government towards various orders passed by the division bench and referred to the order passed by the bench on May 6, 2015 wherein it had taken a serious note of inaction on the part of the state government in not suggesting mechanism to the court for removing encroachment from the state land measuring more than 20 lakh kanals. The bench had then requisitioned a comprehensive report from the state government till June 10, 2015. After hearing him, the bench directed the senior AAG and the deputy AG to take note of the directions passed by the division bench on May 6, 2015 and file a comprehensive report on behalf of the chief secretary and revenue secretary, suggesting mechanism for removing the encroachments and restoring the encroached state land to its original status. Countering the deputy AG, petitioner's counsel alleged that 'Transfer Industry' was functional in the state government despite the turmoil, but for carrying out the directions of the division bench, lame excuses were being given just to shield the powerful land mafia having connections with the people in power. He also drew the attention of the bench towards the inquiry report submitted by deputy commissioner, Jammu, on September 19, 2016 to the divisional commissioner, Jammu, with regard to the encroachment of state/nazool land in and around Jammu city by land mafia particularly the land falling under khasra Nos 301, 302 and 303 at Jammu Khas near Nandni (near fourth bridge), Jammu. The bench directed the deputy AG to produce the inquiry report of DC, Jammu, stated to have been forwarded to the divisional commissioner, Jammu, on the next date before the bench. The bench also directed the JDA's counsel to file the latest status of the demarcation of land before the adjourned date of hearing. Looking into the paucity of time, the bench deferred the matter for the week commencing November 7, 2016 and said other issues, including the Roshini matter, would be taken on the next date of hearing. |
