Jammu, Nov 25: Principal session judge, Kathua, Vinod Chatterji Koul has rejected the bail application of a rape accused.
After hearing both the sides, the judge said the charge against accused Ganesh Singh, son of Narayan Singh of Dadora, Kathua, was that on September 14 this year, he was hiding in the bushes and when the prosecutrix had gone outside her house. When she reached near the bushes, the accused came out and threatened to kill her with a pistol. Thereafter, he took her towards the bushes and allegedly committed rape upon her twice. About four months before this incident, while the girl was coming home from school, the accused had committed rape upon her on gunpoint for the first time and also prepared her video. On September 18, 2016, when she had gone to fetch water from a bowli, the accused had allegedly intercepted her and tore off her clothes. The court observed that severity of the crime alleged to have been committed by the petitioner, the supporting evidence and all other connected facts, 'do justify an inference that he may misuse the concession of bail to escape the dragnet of law and once that possibility cannot be ruled out, the concession of bail cannot be extended. There are so many aggravating circumstances, which disentitle the him from claiming the concession of bail'. With these observations, the court rejected the bail application. --(JNF) |
