Budget Session notified, suspense over Land Acquisition Bill remains | | | Early Times Report JAMMU, Jan 24: As Governor NN Vohra has summoned the State Legislature from February 10 at Jammu, it is still not clear whether Jammu and Kashmir Government plans to introduce the new land acquisition bill or not. A comprehensive legislation on Land Acquisition Rehabilitation and Resettlement has already been passed by the Parliament and has even received the Presidential assent. The said law has come into force recently with effect from January 1, 2014 across the country except Jammu and Kashmir. Like other laws, the State Legislature has to pass an act on the Central pattern. So far there is no official word on behalf of the coalition Government about introduction of the law in the ensuing session of the legislature . Sources close to the Law Department have however given an indication that such a draft is in the process of making and an expert group consisting of eminent legal luminaries within and outside the state are already on the job. Whether such a draft would be ready for tabling the same in the upcoming session of legislature is still not known. The law has great importance viz a viz J&K State as scores of centrally sponsored developmental projects are under construction in the state. The Government has acquired land after 2011 for such projects and in future also land would be acquired for the same and it would be sheer injustice with people of J&K if they don't get the compensation as per new Land Acquisition Act i.e. 4 times in rural areas and 2 times in urban areas. Pertinent to mention that thousands of litigations are pending in the courts of the state questioning the unilateral awards passed by respective collectors and even forcible acquisition made by the state machinery . The new land law if enacted in J&K would not only give a sigh of relief to the aggrieved parties but will also rationalize the admissibility of the compensation commensurate with the growing market rates of land and structures and also their resettlement and rehabilitation issues. |
