Prosecution failure leads to acquittal of narco- smuggler | | | Jammu, Mar 14: Principal Sessions Judge Jammu R S Jain acquitted one Mustaq Ahmed Tak who was facing trial in charas smuggling as prosecution failure when witnesses contradicted each other on material points thus making their testimony unreliable. Principal Sessions Judge Jammu after going through the statements of witnesses observed that in the present case, the prosecution witnesses contradict each other on material points which make their testimony unreliable. And Court further observed that prosecution has failed to prove the guilt of accused beyond reasonable doubts by cogent and clear evidence, as such, accused Mustaq Ahmed Bhat is acquitted. Prosecution case against prosecution case against accused Mustaq Ahmed Tak on 24/5/2012 while driving a car (JK02AG/0923) was stopped at Panama Chowk, Jammu by the police and on checking the vehicle and on statement of accused charas weighing 08 kgs 764 grams was recovered. Accordingly, FIR No.98/2012 of police station Bahu Fort, for offence u/s 8/20 NDPS Act was registered against accused and challan was presented against accused in Court. (JNF) |
