HC clips wings of JKCA general Secretary | | | Sumit Sharma

jammu, Mar 14: Though the Police are investigating the alleged misappropriation of the funds in the Jammu and Kashmir Cricket Academy (JKCA), the JKCA has again hogged the headlines as this time around The Jammu and Kashmir High Court has directed General Secretary of the association M L Nehru not to exercise his powers independently. The High Court clipped the wings of the General Secretary of the JKCA after Ravinder Singh and others raised questions mark over Nehru's election to the post. They claimed that Nehru is not eligible for election to the said post as he was placed under suspension when he was the JKCA president and was restrained from acting or representing, the JKCA in any manner or capacity and the suspension was conveyed to him by the then Honorary General Secretary of the Association vide letter No JKCA/K-GS/S/2214-2217. He (Nehru), however, later got stay on his suspension on 21/4/2011.Taking the interim stay order on ground, he contested JKCA election and was elected as General Secretary of the JKCA on 12/5/2014, however, the said writ petition has was dismissed by the court on 25.8.2014 as withdrawn and with the withdrawal of the writ petition, suspension of the General Secretary JKCA becomes operative and his election on the strength of the interim order passed by the court on 21.4.2011 becomes illegal. After hearing the petitioner court observed, " M.L Nehru while performing functions as General Secretary of the Association, shall restrict himself only to give effect to the decisions taken by the association and shall not exercise any independent power". Court seeks appearance of the complainant and respondent on20.03.2015. Pertinently this is not the first time, the court has intervened in the working of the JKCA as earlier Chief Judicial Magistrate, Kashmir had directed SSP Srinagar to lodge FIR against Moti Lal Nehru, General Secretary JKCA, Arvinder Singh Mickey, Chairman JKCA and Bashir Ahmed, Branch Manager J&K Bank, Air Cargo branch Srinagar for misappropriation of the funds worth lakhs. Court also directed SSP to get the matter investigated under his supervision with the further direction to file the action taken report in the court. Further, the Court of 3rd Civil Sub-Ordinate Magistrate, Jammu had passed an order dated 26-09-2014 in case titled "Sudershan Mehta & other vs Jammu & Kashmir Cricket Association" that the committees constituted by the General Secretary by the way of notification dated 25-05-2014 & notification dated 18-09-2014 whereby selection committees for various age groups & a committee usurping the powers of Jammu wing had been constituted had been stayed.
