Kalakote election 2009: HC directs respondents to file response within week 3/14/2015 11:25:06 PM Early Times Report Jammu, Mar 14: In an election petition filed by Ashok Sharma in the year 2009 challenging the election of 2009 of Kalakote in which NC Candidate Rashpal Singh was declared elected, the Justice Tashi Rabstan directed the respondents to file their response within a period of one week from today. When the case was taken up on 06/03/2015, Justice Tashi Rabstan observed though the instant petition came to be filed in February, 2009, yet the respondents have failed to file written statement despite lapse of so many years. Justice Rabstan after hearing both the sides observed that in view of the law settled by the Supreme Court in Kailash v/s Nankhu that the provisions contained in Rule 1 of Order VIII of CPC have to be construed as directory and not mandatory and the fact that this Court never directed the respondents to file their response till 03/07/2010 and thus the court deemed it proper to direct the respondents to file their response within a period of one week from today.
