Life-imprisonment, RS 50,000 fine awarded to Hizb Divisional Commander | | | Jammu, Mar-25: Principal Sessions Judge Bhaderwah today awarded life-imprisonment to one Farooq Ahmed alias Fareed, code Khalid S/o Abdul Rashid Sheikh R/o Basti -Bhaderwah self styled Divisional Commander Hizbul Mujahideen (HM) who was involved in murder case. After hearing both the sides, Principal Sessions Judge Bhaderwah Sanjeev Gupta observed that the purpose of just punishment is designed so that the individual in the society which ultimately constitute the collective do not suffer time and again for such offences. While carrying out this complex exercise, it is obligatory on the part of the court to see the impact of the offence on the society as a whole and its ramifications on the immediate collective as well as its repercussions on the family of the victim. With these observations Court awarded rigorous imprisonment for life and a fine of Rs.50,000/- under section 302 RPC. Court added in default, the convict shall undergo simple imprisonment for one year and is further sentenced to undergo rigorous imprisonment for five years and a fine of Rs.5000/- under section 307 RPC. Court said the aforesaid sentences shall run concurrently. It is worthwhile to mention here that Farooq Ahmed alias Fareed, code Khalid was also allegedly involved in more than 200 killings of civilians as per sources. Brief facts of the prosecution case are that on 19/10/2000 a source informed Police Station Bhaderwah to the effect that at 21.30 hours some unknown militants after hatching a conspiracy barged into the house of Aijaz Ahmed (Deceased) and Arshad Ahmed sons of Fazal-ullah Khan situate at Basti, Bhaderwah with arms and ammunition with criminal intention and opened indiscriminate firing resulting serious injuries to which Aijaz Ahmed succumbed to his injuries on the spot while Arshad Ahmed was rushed to the hospital for treatment. During investigation it came to fore that deceased Aijaz Ahmed, code 'Bita' was a surrendered militant of banned militant outfit HM who was being pressurized by the active militants of the aforesaid outfit to again come back to their fold which was refused by the deceased and having felt insulted by the refusal of the deceased, the accused persons took extreme step.
