Jammu, Apr 8 (JNF): Principal Sessions Judge Jammu RS Jain rejected the bail application one Suresh Kumar who was arrested by the police in NDPS Case. As per the police report filed by Incharge, Police Post Ponichak, Jammu on 23.3.2015 during naka duty the police apprehended the accused Suresh Kumar and recovered 6098 capsules of illicit drug from the possession of accused Suresh Kumar and the capsules were SPM-PRX and parvon spas and thus FIR for offence u/s 8/1/22 NDPS Act registered in police station. The question arises, should the accused be keeping such a large quantity of capsules in his possession and if he was keeping the illicit drug in such a large quantity in his possession while on the street, it cannot be obviously for his personal use but rather to deal in illicit trade of selling the same to the drug addicts. Keeping in view the enactment of the NDPS Act is to curb the ever increasing menace of drug peddling and illegal sale and its ramifications on the society and the youth in particular and cause for increase in the crime rate, nature and seriousness of accusation against the applicant, the character of evidence, circumstances which are peculiar to the accused, the larger interest of the society and State, this Court is of the view that no good ground is made out by the petitioner/accused Suresh Kumar for enlarging him on bail. Any observation made in this bail application will not prejudice the merits of the challan, as and when filed. The bail application is rejected. |
