Woman among three convicted in assualt on police

Jammu, Apr 17: Principal Sessions Judge Kishtwar Ms Bala Joyti awarded one moth conviction and fine Rs 5000/- each to Mohd Iqbal, Ghulam Fatima alias Guddi and Haq Nawaz for having attacked police team in their common intention to repel legal action of police personnel on 03/08/2006.
Principal Sessions Judge Kishtwar Bala Joyti after hearing both the sides held that prosecution has successfully proved accused persons' guilty under section 353/34 RPC as they have acted in execution of their common intention to repel legal action of police personnel. However offence under section 333 RPC i.e causing grievous hurt is not established against them, court observed and said the accused convicted u/353/34 RPC are sentenced to undergo imprisonment of one month each or pay a fine of Rs.5000/- each in default of payment they will serve one month's Imprisonment u/s 353/333/34 RPC as trio have acted in their common intention to repel legal action of police personnel on 03/08/2006.
As per prosecution case ASI Abdul Rashid lodged complaint against accused persons alleging that while he was on patrolling duty at about 11:30 AM, near office of SDM Kishtwar a Matador (JK06- 0736) was seen parked wrongly by accused no 2 thereby disrupting the entire traffic. He and DySP Liyaqat Ali asked the driver to clear the road but accused attacked police party. They also pelted stones and inflicted injuries on DySP Liyaqat Ali, Constable Roumala Devi and Follower Mushtaq Ahmed. Accused Mst Ghulam Fatima inflicted injury to DySP and also snatched mangal sutra of lady constable. According an FIR 173/2006 under various sections was registered against accused persons.
