HC serves show cause notice to Dir Horticulture over contempt | | | Early Times Report
Srinagar, June 6: High Court J&K high Court has directed registry to frame rule against Director Horticulture and asked him to showcause why he may not be punished for having committed contempt of the court. A single bench of the court also directed its registry to serve copy of the rule on him forthwith, asking him to show cause as to why he may not be punished. The Director P K Sharma was found by the court to have violated its directions by referred the case of the petitioner Mr Tantrey to the concerned Commissioner Secretary instead of implementing the court direction. "The Director Horticulture has deliberately and intentionally violated the court orders. Prima-facie he has committed the contempt of the court," the court observed and asked the Director to remain present before the court on June 9. The petitioner was sent to the Medical Board by the department for ascertaining his actual age and in this regard communications and orders were issued by the department in the year 2014. Meanwhile aggrieved of the orders and communications, the petitioner submitted to the court through his counsel S R Hussain that once the bio data is entered in the service book records it is deemed as final. Despite directions by the court, he was not allowed to resume his duties compelling him to file the contempt petition. On May 1, the Director, who was present in person, had assured the court that the Tantrey will be allowed to continue in service. Meanwhile on latest hearing before the court, counsel representing the Director submitted that the Director has referred the matter to the Commissioner Secretary. Following this, the court issued the notice. |
