Allotment of contract for helicopter service on Katra-Sanjichat route HC dismisses petition of Pawan Hans Ltd 8/1/2015 11:46:46 PM Early Times Report Jammu, Aug 1: High court judge Bansi Lal Bhat has dismissed a petition of Pawan Hans Ltd as regards the operation of helicopter between Katra and Sanjichat. The court directive came in a petition filed by Pawan Hans Ltd against the order of District Judge, Reasi, on his application filed under Order 39 Rule 1 and 2 CPC. The dispute inter se the parties relates to allotment of contract for operation of helicopter flights on Katra-Sanjichhat-Katra route. Vide NIT dated 30.10.2013, Shri Mata Vaishno Devi Shrine Board, Katra, invited tenders from registered aviation companies having a fleet of minimum three airworthy light helicopters for operating flights on Katra-Sanjichhat-Katra route purely on leave and licence basis for a period of three consecutive years w.e.f. 1st April, 2014. The flight operations were meant for providing facilities to the yatries intending to pay obeisance at the Holy Cave of Mata Vaishno Devi. Justice Bhat, after hearing both the sides, observed that petitioner having failed to demonstrate existence of a prima facie case in its favour and balance of convenience not tilting towards it and further no irreparable injury being shown to have been caused to petitioner by rejection of its price bid coupled with the fact that he has failed to demonstrate that the decision making process in allotment of contract in favour of private respondents suffered from any material irregularity, it is found that the impugned order does not suffer from any legal infirmity. The trial court has exercised its discretion of declining the equitable relief of injunction on sound judicial principles and same does not warrant interference by this court.
