Court makes absolute interim order | Meeting of JKCA Committee | | Early Times Report
Jammu, Sept 15: In an application filed by JKCA chairman Arvinder Singh Micky, seeking stay on the operation of notice issued by JKCA vice- chairman for holding a meeting in which on July 20, 2015 (court stayed the operation of July 9, 2015 notice whereby a working committee meeting was called issued by vice-president JKCA is stayed and also directed in case working committee is held pursuant to notice dated July 9, 2015 before communication of this order to non-applicants, in that eventuality decision if any taken in meeting shall also be kept in abeyance till next date of hearing and is subject to objections from the respondents. Today, special mobile magistrate, excise, Yash Paul Sharma, after hearing the plantiff's counsel, observed that it cannot be said that injury likely to be suffered by the plaintiff would be one which can be compensated later on by adequate means if injunction is refused when plaintiff has succeeded to show a good prima facie in his favour. Accordingly in view of discussion made herein above besides the mandate of law , the injunction deserves to be granted to the plaintiff, as such ex-parte interim injunction is hereby made absolute till disposal of the main suit. The observations made if any in the order are purely tentative which shall have no ill-affect on the merit of the case.(JNF) |
