Illegal physiotherapy clinics: SIC issues penalty notice against Dy Director Health for denying info | | | Early Times Report Srinagar, Sept 15: The State Information Commission (SIC) has issued a penalty notice against former Chief Medical Officer Baramulla, now posted as Deputy Director Health Services Kashmir, for denying information about illegal physiotherapy clinics in Sopore. Details available with Early Times reveal that a complaint was received by the SIC from one Khazir Muhammad Lone against former CMO Baramulla, alleging that he had not provided information as per the RTI Act. The complainant submitted that he had filed an RTI application before CMO Baramulla seeking information about physiotherapy units established in the district. The CMO failed to provide information in response to the application filed on January 2, 2015. Thereafter, the complainant had filed an appeal before the Director of Health Services Kashmir, who directed CMO Baramulla through PIO on April 6. But after many reminders the CMO did not provide the information. The complainant then approached the CIC and sought action against the CMO Baramulla. In response to the notice of the Commotion dated July 16, the incumbent CMO Baramulla, Dr. Bashir Ahmad Chalkoo, filed reply vide letter dated July 27 submitting that he assumed the charge on June 11. Therefore the question of delay regarding providing of information under the RTI Act, 2009 does not arise. He also submitted that though registration of clinical establishment are within the competence of DHS Kashmir, he has enclosed information as requested by the applicant. On August 25, the SIC issued an order, which read: "Prima facie it is evident that the RTI application has not been disposed of as prescribed under the Act. It is also evident that the present CMO is not at fault for delay, as he was posted as CMO on June 11 and complied with notice of the Commission dated July 16 by providing information on July 27. In view of the above, Registry shall issue notice to the then CMO Baramulla, during whose tenure the RTI application has been filed and remained pending disposal, seeking his explanation as to why penalty should not be imposed on him under Section 17 of the Act for delay." |
