HC directs SVO to produce entire record | Alleged hushing up of RDA scam | | Early Times Report
Jammu, Oct 12: In the PIL alleging hushing up of Rajouri Development Authority (RDA) scam, a high court division bench of Justice Dhiraj Singh Thakur and Justice B S Walia today directed State Vigilance Organisation (SVO) to produce the entire record of verification No 31 of 2009 wherein it had recommended regular departmental action against the RDA officers when the SVO director had initially approved registration of formal case against the suspect public servants for in-depth investigation. The bench directed that on production of record the same shall be allowed to be perused by the petitioner's counsel who would file his response thereafter. The bench directed the registry to list the PIL in 2nd week of November. When the PIL came up for hearing, the court's attention was invited towards the SVO response wherein it was submitted that the report of branch SSP was examined in the Central Office of Vigilance Organisation and the branch SSP vide letter dated March 26, 2015 was asked to furnish draft FIR in the matter. The Branch SSP accordingly provided draft FIR vide his letter dated April 1, 2015 and the central office examined the draft FIR vis-a-vis detailed report submitted earlier by the branch SSP alongwith the reports of XEn Vigilance organisation, Jammu. The AAG, appearing for SVO, submitted that no criminality was found on the part of delinquent public servants and it was considered appropriate to apprise the government regarding lapses found to have been committed by the suspect public servants namely Javed Ahmed Khan then RDA Chief Executive Officer and Devi Dass Heera, then RDA Executive Engineer. While rebutting the SVO reply, the counsel pointed out that in the instant case the proved case of corruption was converted into censure just to shield the influential RDA officers. He submitted that the Branch SSP in the inquiry had assessed the pecuniary loss to the state exchequer due to non invitation of tenders and initially Director SVO accepted the said inquiry and accorded approval to the registration of FIR. He submitted that the records of the case needs to be summoned so that a view is taken by the court as to how the report of Branch SSP was bypassed by the central office. The bench then directed SVO to produce the record of the instant inquiry and records shall be allowed to be perused by the counsel for petitioner who was asked to file the response afterwards. Looking into the importance of issue, the bench directed the registry to list this PIL in the 2nd week of November 2015.
