SIC puts ZEO on penalty notice

Srinagar Oct 27: The state information commission (SIC) has put ZO Tral on penalty notice for his failure to information about an illegally sanctioned Government primary school under RTI Act within stipulated time. It is alleged that the school was illegally sanctioned as the student strength was too less and all this was done to accommodate two blue eyed people. The school as on date has been closed down by authorities as there were hardly any students enrolled in the said school.
Details available with Early Times reveal that State Information Commission (SIC) received a complaint from one Aamina Jan W/o Bilal Ahmad Naik R/o Tral Payeen Kandistan , District Pulwama on 3.08.2015 against ZEO Tral for not providing information under RTI Act 2009 for the last two months. The information seeker had sought information related to sanction of Primary School Kandistan Tral which the information seeker alleges that was sanctioned in violation of SSA rules. The information seeker sought copies of engagement orders of both the RET’s working at the said Primary School. In addition to it photocopy of year wise roll statement of students with parentage from the day school was opened in the village until its closure was also sought . The applicant sought some more information as well . In her complaint filed before SIC it is alleged that ZEO failed to provide the said information after expiry of more than two months. Accordingly, the complainant requested the Commission (SIC) to take action against the ZEO as he has failed to deliver justice with her and failed to perform his legal duties. Nazir Ahmad Bhat, ZEO Tral filed reply to the notice of the Commission on 20.08.2015 submitting that complainant Mst. Aamina Jan W/o Bilal Ahmad Naik R/o Tral Payeen Kandistan Tehsil Tral District Pulwama approached his office a few times for getting the information under RTI Act 2009. The said information according to ZEO was prepared well in time, but she did not receive it by giving one pretext or the other. However as per ZEO’s written submission before SIC , his office dispatched the said information to her on 05.08.2015 through registered post. .
The representative of the appellant Mst. Akther Akbar submitted before SIC during case hearing on 20.10.205 that she received the information on 7.08.2015 and alleged that information given to her was incomplete. ZEO Tral produced before the Commission copy of letter dated 05.08.2015 under which 169 pages of information had been sent to the information seeker. During the case hearing at SIC office Srinagar the complainant also pointed out that there is some discrepancy in respect of information provided to her through registered post and information now produced by the ZEO before the Commission in respect of Roll statement for the years 2014 and 2015.
SIC’s judgement reads as : “Since the appellant has alleged that information given to her through registered post is incomplete, ZEO is directed to provide an attested set of the information produced before the Commission along with correct information as per records regarding Roll statements as stated here-in-above. The information should be delivered through prescribed mode of service within 10 days.
The Commission has noted that ZEO Tral has not brought on record any evidence to show that RTI application filed on 25.05.2015 was responded to by him within the period as prescribed under the Act. The only documentary evidence brought before the Commission is the photo copy of dispatch receipt through registered post on 5.08.2015, which is well beyond the period prescribed under Section 7 of the Act. In view of the above Nazir Ahmad Bhat, ZEO is given an opportunity to explain as to why penalty under Section 17 of the Act shall not be imposed against him for such delay.
His explanation, if an, should reach the Commission within a period of two weeks time”
