PIL on delay in finalisation of 147 departmental inquiries | HC directs 13 administrative secys to file status of inquiries within 2 weeks or appear in person | | Early Times Report
Jammu, Feb 10: A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today expressed its displeasure over delay caused in the finalisation of 147 departmental inquiries pending against various officers of the state government occupying responsible positions. The bench, looking into slackness on the part of 13 administrative departments, directed their secretaries to file the status of the pending departmental inquiries within two weeks failing which they were directed to remain present in person in the court on February 23, 2016, ie the next date of hearing. Earlier, the petitioner's counsel drew the attention of the bench to the December 17, 2015 order whereby GAD had been directed to file the updated status of the 147 departmental inquiries within two weeks. It was submitted that the GAD had failed to file the updated status of the departmental inquiries. The counsel referred to the last status report filed by GAD on November 4, 2015 wherein it had expressed its helplessness as it was averred in the report that only 5 departments responded with the fresh status report and response from rest of the 16 departments was still awaited. The attention of the bench was also drawn to the court order passed on April 4, 2014 when the bench headed by then Chief Justice M M Kumar had expressed annoyance over the lackadaisical approach of the state government in non-finalisation of 147 departmental inquiries and castigated the government for concealing from the court the particulars of the officers facing departmental inquiries. The bench had then directed the GAD to have a time bound action in the matter. At this stage, the bench headed by Chief Justice N Paul Vasanthakumar expressed its anguish over the non-finalization of the 147 Departmental inquiries and asked the advocate general for reasons of delay in the finalization of 147 departmental inquiries. He submitted that 13 departments -- Public Works, CAPD, Finance, Technical Education/YSS, PHE I&FC, School Education, Higher Education, Revenue, Housing and Urban Development, Social Welfare, Agriculture Production, Planning and Development and Industries and Commerce -- had not responded to the various communications issued by GAD. He said even the five departments, which had responded, had not achieved further progress in the inquiries. After considering the submissions from both the sides, the bench expressed its displeasure over the 13 administrative secretaries and impleaded them as party respondents in the PIL. The bench issued notices to them which were accepted by the advocate general. The bench directed them to file the status report with regard to the pending departmental inquiries within two weeks from today failing which they were directed to remain present in court in person.
