8 posts of judges vacant in HC, 25 in district/sub-ordinate courts | Litigations pile up, appointment of new judges still in oblivion | | Akshay Azad

Jammu, Aug 14: The vacant position of judges in Jammu and Kashmir High Court (HC) along with district and subordinate courts has resulted into further piling of cases. There are remote possibilities of filling up of posts as it is still unknown about the fate of file, forwarded by Collegium of HC for the appointment of judges. Sources in the Law department informed Early Times that the Collegium of High Court had reportedly forwarded the file to Governor's office, Union Law Ministry, Supreme Court and State Government during breief stint of Governor rule, in which eight names were recommended for the appointment of High Court judges. "Initially there were some reports that the file was returned back for reconsideration and there were some other hurdles but for the last nearly two months, we are totally unaware about the fate of the file forwarded by the Collegium", an official in the Law department, pleading anonymity said. On one hand there is delay in the appointment of judges and on the other the pendency of cases has been increasing with each passing day. As per the recent data furnished by Law department, the pending cases in Jammu and Kashmir High Court on 31/12/2015, was 56,453 cases. The total strength of Judges of High Court is 17 including Chief Justice but at present only nine judges are in place and eight posts of judges are pending. Besides in the district courts and sub-ordinate courts the total posts pending are 25 while the number of cases pending in these courts are 1,24,763 as on 31/12/2015. Due to delay in appointment of judges the cases have been piling up in district/sub-ordinate courts and also in High Court. The filling up of the vacancies in the High Court is a continuous consultative process among Constitutional Authorities to select suitable candidates for higher judiciary and is time consuming, sources said, adding that whereas the filling of vacancies of Judges/Judicial officers in Districts and Subordinate Courts is within the domain of the State Governments and the High Court. |
