HC orders GDA to remove all illegal constructions | | | Early Times Report
Srinagar, Sept 24 :Observing that the government was duty bound to enforce law of the land, the state high court has directed Gulmarg Development Authority (GDA) to remove all the illegal constructions that has come up at Gulmarg, the world famous tourist resort in north Kashmir's Baramulla district. "GDA CEO is directed to take action in accordance with law and in terms of court orders. He shall also take action in light of the two reports of the court commissioners," said a division bench of Justice M H Attar and Justice Ali Mohammad Magrey and made it clear to the GDA CEO to ensure that no illegal construction is allowed to be raised within his jurisdiction. The bench also directed the CEO to ensure that all illegal encroachments were removed before the next date and possession of the property taken. SDM and SDPO of Gulmarg were also asked to render all assistance to the CEO for enforcing the law and implementing the court orders. It posted the PIL for further consideration and filing of the compliance report in the week commencing from October 17. Assistant Solicitor General of India S A Makroo submitted on behalf of Army stationed in and around Gulmarg that the court commissioners have made recommendations for repair of internal roads and repair of damaged water pipes for supply of drinking water. "The competent authority will pass orders in accordance with law and in the light of recommendations of the court commissioners," the bench said. The court also observed that Kashmir Valley was losing everything like Dal Lake, Jhelum, Pahalgam and other tourist places. "Big persons are in illegal possession of state land. If there would be a poor man in their place, you would have thrown him out within seconds," the court said and reminded the government of its duty to enforce the law of land. Last year, the court had ordered the DC and SSP, Baramulla, to stop all the activities related to construction at Gulmarg. "If any person violates the court directions and continues with construction, the aforementioned authority shall forthwith seal such structure," the court had said. The bench had also directed that all the vehicles which are found transporting construction material to Gulmarg should be seized and the applications for release of the vehicles should be listed before the PIL bench and no other court shall entertain such applications.
