Jammu, Feb 22: In a significant order a Division Bench of the State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Ali Mohammed Magrey issued notices to Commissioner/Secretary to Govt. of J&K, General Administration Department and Commissioner/ Secretary to Govt. of J&K, Home Department in a petition seeking initiation of disciplinary proceedings against two IPS Officers of J&K Cadre namely Atul Goel (IPS) the then SSP Jammu and Anand Jain (IPS) Former SSP Jammu for misusing/abusing their official position by providing undue security cover to Kewal Kumar Sharma, Forest Guard turned Additional PRO to the then Deputy Chief Minister J&K, Tara Chand.
Advocates appearing for the PIL submitted that the State High Court had passed strictures against the Former SSPs for providing undue security cover to Forest Guard Kewal Kumar Sharma and not only this the Division Bench vide its order dated February, 3, 2016 had reserved the liberty to the petitioner to approach the competent authority in the State Government with regard to the initiation of Department action against the delinquent former SSPs.
After considering the submissions of Advocates appearing for the PIL, the Division Bench headed by Chief Justice Badar Durrez Ahmed directed both Commissioner/Secretary to Govt. of J&K, GAD and Commissioner/Secretary to Govt. of J&K, Home Department to file their response to the fresh miscellaneous petition within two weeks.
