Keeping in view the ratio of Division Bench judgment cited herein above, on the face of it, the appointments based upon such a selection cannot be permitted to be made. Prima facie a case has been made out and issued notice to the respodents returnable within two weeks and in the meantime, subject to objections and till next date of hearing before the bench, selection/appointment of private respondents shall remain stayed. |
