Rigorous life-imprisonment to husband in dowry death case | | | Early Times Report Jammu, May 30: Principal Sessions Judge Kathua Sanjeev Gupta today awarded rigorous life-imprisonment and fine Rs 20,000 to Mohinder Kumar S/O Late Tara Chand R/O Galak (Jasial), Tehsil Billawar, District Kathua who was facing trial in murder of his wife Pinky Devi in dowry death case. Principal Sessions Judge Kathua Sanjeev Gupta after hearing Public Prosecutor BB Sharma for the State whereas Adv KB Mahajan for the accused observed that fundamental purpose of imposition of sentence is based on the principle that the accused must realize that the crime committed by him has not only created a dent in his life but also a concavity in the social fabric. The awarding of life sentence is a rule and death is an exception. The application of the 'rarest of the rare' case principle is dependent upon and differs from case to case. With these observations Court awards rigorous life-imprisonment and fine Rs 20,000/-. Principal Sessions Judge Kathua Sanjeev Gupta further observed that Keeping in view the poor status of the family of victim, which must have undergone trauma due to barbaric murder of deceased at the hands of convict, I think State should be burdened to provide monetary assistance to the family of victim out of its own funds, because it is the protector of life and property of its citizens being their custodian. Therefore, in my view, a compensation of Rupees Two Lacs will be just and reasonable amount for providing financial assistance to the family of victim, which shall be paid within one month by the Member Secretary, Jammu & Kashmir State Legal Services Authority. |
