Land for Ring Road: HC comes to rescue of Jammu farmers | | | Early Times Report Srinagar, May 30: After issuing an interim order in favour of farmers affected by Semi Ring Road in Srinagar, the Jammu and Kashmir High Court has issued a similar order in favour of farmers affected by Ring Road in Jammu. Justice M K Hanjura in his order has directed the government to consider payment of compensation to farmers from Jammu as per October 4, 2017 communication of National Highway Authority of India (NHAI) wherein they had agreed to pay four times compensation than market value of land to farmers affected by Ring Road project in Budgam. The High Court, after hearing a petition filed by affected farmers from Jammu region through their counsel Abhinav Sharma, directed J&K government to file its objections. Justice M K Hanjura directed the respondents to consider the payment of compensation as per the previous communication of NHAI. Only few days back, High Court acting Chief Justice, Justice Alok Aradhe had directed that all the record of land acquisition in Chadoora sub division in Budgam be immediately transferred to Sub Divisional Magistrate (SDM) Chadoora so that he can take up the process of land acquisition in his sub division which until now had been undertaken by Assistant Commissioner (Revenue) Budgam. As reported by Early Times, Sub Divisional Magistrate (SDM) Chadoora Budgam vide SRO 354, had been designated as Collector Land Acquisition, but the SDM did not hand over the documents and record by the authorities particularly the Collector LA Budgam tehsil/ ACR Budgam. After being ignored to perform his duties collector land acquisition in Chadoora sub division , SDM Chadoora Shabir Ul Hassan had written a letter to DC Budgam vide letter No: SDM/Misc/ 2088-92 Dated 31.10.2017 wherein SDM / Collector requested Deputy Commissioner Budgam to transfer land acquisition record from ACR Budgam's office to Chadoora. But inspite of a laspse of more than seven months the record is yet to be transferred to SDM's office and people continue to suffer. As some locals of Kuzwera Chadoora had filed a petition for payment of unfair compensation by government, this matter was also agitated in the writ petition which was listed at serial no 10 (supplementary cause list). Counsel for the petitioners Advocate Altaf Haqqani agitated that farmers are paid unfair compensation during land acquisition. To this lawyer representing NHAI reiterated that they are ready to pay four times more compensation to affected farmers provided J&K government adopts central Land Acquisition Act. Justice Aradhe directed the government to transfer record to SDM Chadoora plus payment of fair compensation. The case is again listed for hearing next month. |
