| Tractor driver sentenced to 2 years imprisonment for killing pedestrian | | | Early Times Report
Jammu, July 12: Special Municipal Magistrate Jammu Manoj Parihar sentenced awarded 2 years imprisonment to Rajinder Kumar tractor driver for killing a pedestrian.
As per the prosecution, Tractor bearing no. JK02F/3912 driven rashly by accused was coming from Gole Pulli towards Poonch House at 4:30 p.m near Ganda Nallah main road Talab Tillo, the accused could not keep the control on the Tractor, caused accident with one person Madan Lal, who got injured and was admitted to GMC, Jammu, the injured succumbed to his injury. The investigation was ensued. After investigation offence u/s 279/304-A RPC were proved against the accused.
Special Municipal Magistrate Jammu Manoj Parihar after hearing Adv Kunal chib for the accused whereas Prosecuting Officer Altaf Wahid for the state observed that the charge against the accused is found to be proved by the prosecution beyond reasonable doubt.
The ingredients of offences under section 279 and 304-A are proved against the accused. As such, the accused is found guilty in offence under section 279/304-A RPC and accused is accordingly convicted and sentenced to undergo simple imprisonment for 06 months under section 279 RPC and two years under section 304-A RPC. These two sentences shall run concurrently. |
