Fax Machine - Responsible for Death of Democracy

The dissolution of J&K assem
bly by HE Governor on 21st of November 2018 is not an event that happened for the first time in the history of J&K. There have been many mature and aware voices resonating including that from political platters, social organizations and from common house and many freelance writers scripting asking for the same fate of assembly, since the day one government dismissed and assembly placed in suspended animation. But the way end of the assembly came like a hurricane has shattered the aspirations of almost all the political parties who were carrying the nightmare of again capturing the musical chairs by any worst possible trickery and it was the BJP much busy in achieving this goal since the day one of the new Governor on the chair that was reacted by BJP state President as their own man. The article of the writer 'Suspended animation - keep MLAs happy' finding space in Early Times dated 16 July 2018 and 'J&K Assembly in suspended animation - reviewable decision' finding space in Greater Jammu dated 25 August 2018 were exhaustive and elaborate on the issue of dissolution of the assembly. What prompted to arrive at the final call by H E Governor need not require any repetition in this write up but it is worthwhile to script that the decision landed without loss of time after People's Democratic Party (PDP) leader and former chief minister Mehbooba Mufti released a letter on Twitter announcing that she would seek to form the government with her traditional rivals, the National Conference (NC) and Congress. It was followed by People's Conference chief Sajad Lone's (Dissidents of the PDP supported by Sajad Lone's Peoples Conference have been speaking of a government formation in the state with the support of the BJP ever since Governor's rule was imposed) letter to the governor on WhatsApp, putting forth a similar bid. Interestingly both the claimants came to the rescue of the social media i.e. Twitter and WhatsApp for their claims citing the reason that the 'Fax Machine' at the governor's residence seem to be neither working nor H E available on the phone. It was supplemented by ex CM Omar Abdullah, this is for the first time that a fax machine didn't work and became responsible for the death of democracy. The present dissolution arrived by the Governor feeling impossibility of forming a stable government by the coming together of political parties with opposing political ideologies. The coming together of such parties in a grouping is nothing but an attempt to gain power rather than to form a stable government (how this assumption would have stand the test of reality is million dollar question) and complaints of horse trading (At what time received and their source also falls under question mark) were main reasons for dissolution of the assembly. At the backdrop of this conclusion, we are supposed to revisit the media reporting just two days back 'J&K heads for Prez rule, assembly not to be dissolved for now: Malik' and 'I still do not see any government formation. No party has number so far'. Whether in actuality these are the reasons for dissolution of assembly cropped up just only after the developments of claims of forming the government and arriving at the decision with minimum time slot is a valid question requiring debate in the public forum? Another aspect requiring mention here is, If at all such developments of horse trading were cropping that cannot be construed as a patch up within three political parties quite in opposing posture, concluded within two days, can well be commented as weak feedback by those supposed to keep the HE informed on political developments in the state. It is also in public domain that BJP was trying to make their government but were failing. When they saw that another government could be formed, they managed the dissolution of the Assembly without looking for the constitutional measures. The other aspect here is with regard to the various statements that echoed from political corners as aftermath of the unexpected announcement. The Kavinder Gupta from Jammu, once speaker of the BJP-PDP coalition government and Dy CM appeared on national TV and remarked immediately after PDP-NC-Congress staked its claim of government that they all are Pakistani sponsored people. They held meeting in London, Dubai, and it is on the directions of Pakistan they are forming an alliance. This speaks of the person either well in knowledge of these blessings of the Pakistan for the trio and deliberately kept it concealed within his knowledge for ulterior motive or it is brain drain because of the losing power and facilitations on tax payers' money. The Ram Madhav general secretary BJP, man from saffron brigade and in charge J&K affairs remarked that "PDP and NC boycotted local body polls last month because they had instructions from across the border. Probably they had fresh instructions from across the border to come together and form the government". But Omar Abdullah reacted "I dare you to prove it! Place the evidence of your allegation of NC boycott of ULB polls at Pak behest in public domain. It's an open challenge to you & your Govt. This compelled Mr Madhav to surrender and twitted "Just landed@Aizawl n saw this. Now tht u deny any external pressure I take back my comment". It speaks of the immaturity irresponsibility and frustration on the part of this BJP point man. I leave the space to populace to further comment on these irresponsible statements from BJP hawks.
The dissolution of the assembly has also attracted statements from different persons affiliated with political parties. Former CM of J&K Farooq Abdullah slammed the labeling of the proposed PDP-NC-Congress alliance as a combination of "terror-friendly parties" by the BJP and said that "When PDP was in alliance with BJP then it was not 'terror-friendly?' It has become 'terror-friendly' when it talked of an alliance with the NC and Congress? I had a lot of hopes from this Governor, but this is very sad.
He has turned out to be another slave of the Centre. The post of Governor needs to be looked into". Mehmooba Mufti said that it is sad to see what the political discourse of our country has been reduced to. How does one define a party's nationalistic credentials? You are nationalistic and patriotic only if you are with the centre and Pakistan sponsored and anti nationalistic otherwise? We come across a Twit on social media that It (BJP) has been their policy right from taking over Delhi reigns that their supporters are patriots & nationalists and all others anti nationals & non patriots, a latest definition of nationalism & patriotism. Former Bharatiya Janata Party (BJP) leader Yashwant Sinha said, "(BJP) will not allow anyone else to form any government anywhere even if it involves bypassing the constitution. J&K is the latest example of this principle of BJP". Congress leader and former Union minister Kapil Sibal tweeted, "When a Governor brazenly plays politics under instructions 'Satya' becomes a pawn in the hands of 'Asatya' and BJP's shameless power play in J&K is recipe for disaster". While senior Supreme Court lawyer Prashant Bhushan said, "The dissolution of the J&K Assembly by BJP'S political speaker, hours after NC & PDP came together with a clear majority & staked claim to form government there, shows that BJP intends to rule J&K from the centre & its talk about democracy there is all humbug".
The 'Samunder Manthan' of the whole dramatic echoism has come up with two main contentions: the hurriedly taken up decision by His Excellency, the Governor of J&K and the role of fax machine. When we speak of the hurriedly taken up decision by His Excellency and whether it is constitutional or political decision, we are left with only one option and that is of the Apex court for its resolution but in the run up, we don't feel any of the party opting for it as their main focus will be to strengthen their vote bank and to prepare for the next elections that do not appear at a larger distance. Regarding the contention of Fax machine not available for 'incoming' and active for 'outgoing', here involves a dynamism that if the contents of the letter placed on Twitter would have been received by the Constitutional Authority followed by another letter from Mr. Lone, their disposal would have involved a process required to be adopted as per constitutional provision of floor test. Moreover contention that because of Eid holiday, the attendant of Fax machine was not present is not so convincing as how he was available at the time machine was required to be operated for outgoing, when Eid holiday was still in force. Come what may, we will just say "Muddai lakh bura chahe kya hota hai, wahi hota hai jo manjure khuda hota hai".
