Jammu, Dec 19:Justice Sanjay Kumar Gupta of J&K High Court rejected the bail application of Angat Kumar, main accused in alleged Inner Wheel rape case of mentally retarded girl. According to the case, one Aarti Mahajan, complainant in the case, who is a regular visitor to the Rotary Inner Wheel Home for Mentally Retarded Children at Channi Himmat, Jammu approached the police station, Trikuta Nagar with a written complaint in which allegations were made with regard to the physical/verbal/sexual abuse of minor girls, who were inmates of the 'Home' at the hands of accused and others, besides the absence of Government guidelines for the proper functioning of the Home were also highlighted. Justice Sanjay Kumar Gupta after hearing both the sides observed that it is evident that Court shall not grant bail to accused, when it appears that there is prima facie case against accused. In present case, from bare perusal of allegations and other evidence produced so far by prosecution as mentioned in order impugned, it is evident that victims have categorically stated against the accused persons. The punishment provided for offence charged is minimum ten years, which may extend to life imprisonment. With these observations, court rejected the bail application. |
