| With the passing of everyday, the Kashmir problem is becoming grave which is a great danger to the integrity and the sovereignty of the country. It needs utmost importance to settle the same without any further delay as already seven decades are over and it is being lingered on which is a major concern for all of us. Luckily, we are having a dynamic and the decisive Prime Minister Narender Modi at the moment who can clinch the issue involved once for all. The Central Governments from time to time in the past have appointed the various Interlocutors on this score but all in vain. Now the dynamic and the courageous Prime Minister Narender Modi can rise to the occasion and initiate the direct dialogue with the Hurriayat Amalgamation and the Separatists without involving any Interlocutor in the talks. If the need be, he may seek the advice and the guidance from the Nation Security Advisor. Holding of the talks with the Hurriayat and the separatists is required very much to clinch the issue involved as they are the Indian subjects first and then the stake holders. If they will be convinced fully then Pak has no role to play in the process. On being satisfied them, Pakistan be taught a lesson. At the same time, it should be made clear that all out operation shall remain continue during the periodicity of the talks with the Hurriayat Amalgamation. These talks should be held thereby remaining within the frame work of the Indian Constitution treating the Instrument of Accession (IOA) as the base document. At the moment, the Interlocutor appointed by the GOI Daneshwar Sharma is on the job and holding the he could not be able to crack the hard nuts - Hurriayat Amalgamation and the Separatists as on date. This means that he will meet with the same fate as happened in the past seven decades. Why I am saying so because it is a stunning news that Shah Faisal who stood top-one in the Civil Services Examination conducted by the Union Public Service Commission has resigned? Faisal joined the Indian Administrative Service and was allotted his home state to serve. He could not acclimatize with the Administrative atmosphere in the state of Jammu and Kashmir and ultimately resigned from the services. In an interview with Sumit Avasthi of ABP channel telecasted on Sunday, Shah Faisal categorically stated that he is Indian but has pain for the youth of the state who are fighting against the government for the settlement of the Kashmir issue. He straightway stated that he will try his best to work for the welfare for the poor masses of the state as also for convincing the Hurriayat Amalgamation and the Separatist to enter into Dialogue with the Central Government soon. He further stated that by remaining in the government administration he will not be able to deliver the goods to the people of the state and at same time he denied that he is not forming a political party on his own.Prior to this, many scholars, university teachers and professors have joined the terrorists outfits and are demanding Azadi. The Governor of J&K Satya Pal Malik is appealing the misguided youth of the state time and again to come in the main stream and work for the overall development of the state and the country as well but all in vain. Under the prevailing circumstances and seeing the gravity of the bad situation in the state, the Prime Minister of the country Narender Modi who is a dynamic political leader, should rise to the occasion and while following the foot steps of the former Prime Minister of India Atal Behari Vajpayee should initiate the talks with the Hurriayat Amalgamation and the Separatists at the earliest possible. at the earliest possible. I had written many articles in the past on the issue involved and published in this esteemed paper where under I had mentioned that number of my friends (who were my batch mates and had worked with me ) are living over there in Kashmir valley. I love them. But they are opposing me for the reason that whatever I am writing in the print media on Kashmir situation as also for the ultimate solution of the Kashmir issue which is lingering on since 1947, is not based upon the facts. Still they are telling me that I am not writing about the facts and on the contrary they say that you (me) always plead for solving the issue involved militarily instead of the talks between the two nations India and Pakistan. To me, it is hundred percent clear that I am on the right side always. While expressing their concern about the settlement of Kashmir issue amicably through talks only. It is worth mentioning that I am for the liberation of POK in compliance to the LOK SABHA RESOLUTION 1994. I will continue to argue and plead for the same in the right earnest. On the contrary, they challenged me that you ( me) are afraid of narrating the actual facts about Kashmir. Pertinent to mention here that when the division of India was made on August 15, 1947 and Pakistan came into being as an independent Nation on the Globe, J&K was an independent state under Maharaja Hari Singh's Rule. Having felt helpless, due to the Qabailis intrusion in J&K on October 22, 1947, he requested the Indian Government to come at his rescue by sending its Army to defend his kingdom and for providing the life safety and protection to the subjects of this land . Maharaja Hari Singh signed the IOA acceding J&K with India on October 26, 1947. My friends main bone of contention was that I should accept that Jammu and Kashmir state acceded to Indian Dominion on three issues only i.e. Defense, Foreign affairs and Communication as per the Instrument of Accession (IOA) signed by the then Maharaja of J&K state Hari Singh on October 26, 1947. In turn, I accepted that it is a known fact World wide. Then sharply they contested, "that we should stand on these lines firmly". Certainly one thing is there that Kashmir solution is of utmost importance. They made it clear that issue of Kashmir can be thrashed out when Government of India comes to this stand on the three issues which were entrusted to the Government of India only. They opined that an amicable solution to the problem of Kashmir can be found out by sticking to the IOA signed by the Maharaja of J&K. Further they were of the opinion that if GOI stands on this firmly then it will succeed in cracking the hard nuts- Hurriayat Amalgamation and the Separatists which create hindrances in the settlement of the issue involved. They plead firmly that that the Hurriyat groups and the Separatists will agree with the Pre-1953 Kashmir position. They want that there is a possibility of defusing the tangle of Kashmir if GOI remains stick to the issues involved i.e. Defence , External affairs and Communication only. Things can be negotiated at the PM level for which Huriayat may soften its stand on holding of talks for arriving out at an amicable settlement. In the past feelers were also sent to the Separatists and the Hurriayat leadership for talks with the GOI but they kept the distance for the reasons known to them only. Political experts feel that PM Modi may crack these hard nuts. There are feeling among the masses in Kashmir that pre-1953 position could be the lasting solution to the so-called Kashmir problem. Time and again, Dr. Farooq Abdullah and PDP Chief and the former Chief Minister Mehbooba Mufti are pleading for a constructing Dialogue with the Hurriayat Group and the Separatists. Needless to mention here that Article 370 and Delhi Agreement 1952 between the then Indian Prime Minister Jawaharlal Nehru and the then Jammu and Kashmir Waizr-e-Azam Sheikh Abdullah and brought the state surreptitiously within the purview of Central laws and institutions and thereby eroding Kashmiriyat. Jammu and Kashmir state enjoys a separate status under Article 370. It has its own constitution and a separate flag Jammu and Kashmir is also the solitary state in the Indian Union that, unlike other states of the Union, exercises residuary powers. No central legislation can be introduced in the state without the concurrence of the Jammu and Kashmir Government. It is very much debatable as to will this restoration of the pre-1953 constitutional position strengthen democracy in the state or redress the grievances of the Kashmiris and re-empower them? It is also a matter of record that complying with the spirit and the contents of the "Kashmir Accord", Sheikh Mohammed Abdullah took the reigns of the state of Jammu and Kashmir as the Chief Minister in 1975. Immediately after assuming the power, he had appointed a committee under the chairmanship of his deputy Thakur Devi Dass to review all the Laws enacted in the state after1953. The said committee having reviewed the same showed its agreement to all the statutes enacted in the state from time to time by the various State Governments of the time after 1953. Under the circumstances, now it looks certain that the Prime Minister Narender Modi, while giving the due regards to the Apex Court would wait for the verdict over the Ayodhia issue permitting therein for the construction of the Ram temple. At the same time, he would give the top priority to settle the Kashmir tangle and initiate the direct dialogue with the Hurriayat Amalgamation/ Separatists at the first instance and the if the need be , 'II have the dialogue with PAK also in the days to come. |
