Srinagar, Jan 22: Vacation Judge of J&K High Court Srinagar Wing Justice Sanjeev Kiumar while quashing PSA of Bilal Ahmad Bhat son of Mohd Maqbool Bhat resident of Drusso Jageer Rafiabad Sopore District Baramulla held that the preventive detention involves the detaining of a person without trial in order to prevent him from committing certain types of offences, but such detention cannot be made a substitute for the ordinary law and absolve the investigating authorities of their normal functions of investigating the crimes which the detenu may have committed.
Justice Sanjeev Kumar after hearing both the sides allowed the petition and quashed the detention Order no.78/DMB/PSA/2018 dated 26.09.2018, passed by District Magistrate, Baram-ulla and also directed respondents to release the detenue forthwith, provided he is not required in any other case. |
