Prosecution failure leads to acquittal in murder case | | | Early Times Report
JAMMU, Mar 16: Principal Sessions Judge Udhampur has acquitted one Jagan Lal facing trial in murder case as prosecution miserably filed to prove its case. Principal Sessions Judge while acquitting accused observed that the prosecution again had tried to build up that the accused and deceased went together to purchase wine but it is also stated in the prosecution case that deceased had gone alone to the wine shop to purchase liquor and she came back with one pouch of liquor only without bringing separate pouch for the accused: It was alleged that after they had dispute over sharing of liquor they fought with each other to the extent that their clothes got torn and accused in anger took as stone weighing 10 to 15 kg in his hand which was lying thereby and hit the deceased with that stone. With that blow she immediately died. This narration in the challan is not proved. In fact from the appreciation of evidence, there is not an iota of material on the record of the file that they tore each other's clothes. Though it was sought to be attributed that "a torn male shirt" has also been recovered from the spot but there is no proof that the said shit belonged to accused. (JNF) |
