CJM Jammu seeks personal appearance of Chief Engineer PDD | | | Early Times Report Jammu, June 27: The Court of Chief Judicial Magistrate Jammu Deepak Sethi today took serious note of willful and deliberate absence of judgment debtors in a execution of decree. As per the details available with Early Times, the case titled Kulwant Singh (Decree holder) vs Chief secretary and Chief Engineer Power Development Department (Judgemet debtors) in which the court vide order dated 29.11.2008 directed the Judgment debtors to shift the electric poles and transformer installed within the boundary wall of residential house of the decree holder to outside the residential house. Even the court abserved and stated that parties are not at issue and there is no need to proceed further in the matter so in terms of order 15 rule 1 of CPC decree be drawn. Counsel representing decree holder Mohd Irfan drew the attention of the court towards the non appreance of the counsel for judgement debtors despite issuance of notice by Honble court twice, but both the judgment debtors chosen not to appear which shows their contemptous attitude towards the Honble court directions. Counsel for decree holder stated that neither counsel representing Chief Secretary nor counsel representing CE PDD appear before Honble court despite several opportunties given to them following which Honble court after peruse the record issued notice to chief Enginner PDD (Judgement debtor No.2) for his personal appearance on 12th July 2019. |
