DB directives in PIL regarding park facilities | | | Early Times Report
SRINAGAR, Aug 29: In a Public Interest Litigation (PIL) seeking parks facilities in residential areas of Srinagar city, a Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Rashid Ali Dar, directed Srinagar Municipal Corporation to file a status report with regard to the status of installation of coded dustbins for segregated waste as well as the status of parks under its maintenance. When the PIL came-up for hearing, DB observed that the Srinagar Development Department has filed a status report dated 11th July, 2019 and Adv S F Qadri, Amicus Curiae, has drawn our attention to the status report dated 9th April, 2019 filed by the Srinagar Municipal Corporation (page 194). This report refers to our orders dated 11th February, 2019 and 12th March, 2019 with regard to segregation of waste. DB observed that in para 3 of this status report the respondents have referred to a proposal to acquire coded dustbins for segregated waste. DB further observed that the Srinagar Municipal Corporation has not filed any report with regard to the steps taken and the status of acquisition of dustbins for segregated waste. DB also found that the Vice Chairman, Srinagar Development Authority has filed the status report dated 11th July, 2019. In para 2, reference is made to the parks falling in jurisdiction which stands developed by the Srinagar Development Authority in different colonies of Bemina Barthana which were handed over to the Srinagar Municipal Corporation for further maintenance and repairs and vide leter dated 2nd November, 2017, the Srinagar Municipal Corporation has been requested for taking up these parks in hand for further development/maintenance. In para 4 it has been stated that a request has been made to the Administrative Department vide letter dated 10th May, 2018 for administrative approval and release of funds to the tune of Rs. 501.60 lacs for development and maintenance of the parks damaged in 2014 floods. DB directed the Administrative Department as well as the Srinagar Development Authority to inform this Court with regard to the status of release of funds on the next date of hearing. DB further directed Srinagar Municipal Corporation to file a status report with regard to the status of installation of coded dustbins for segregated waste as well as the status of parks under its maintenance.
