Court rejects bail in rape case | | | Early Times Report
Jammu, Aug 29: Principal Sessions Judge Reasi Kamlesh Pandita rejected the bail application of Akshit Sharma son of Davinder Sharma of Ward No 3, Nai Basti, Reasi who was allegedly involved in rape case. According to the police in this case, the complainant, who is admittedly a major and doctor by profession, filed a complaint before the concerned police station that one year before, the accused person/applicant herein with whom she had acquaintance committed rape upon her against her will by administering some medicine in her glass of water, due to which she became unconscious and thereby he committed rape upon her and also took her nude pictures as well as made video of the same and thereafter for the last one year was exploiting her and threatening her of dire consequences due to which she used to submit her modesty to the accused person/applicant herein from time to time whenever he (applicant herein) called her. She also stated in her complaint as well as in her statement that the applicant/accused and other co accused persons called her from her working place i.e BN Hospital Talab Tillo and kidnapped her to Jammu High Court and forcibly solemnized her court marriage under duress. Principal Sessions Judge Reasi Kamlesh Pandita after hearing both the sides observed that while having minute perusal of the record/report made under Section 173 of the Criminal Procedure Code and also while scanning the complaint as well as statement of the prosecutrix recorded U/S 164-A Cr.P.C, there appears to be reasonable grounds for believing that the accusation against the accused person/applicant herein is prima-facie true. Therefore, accused at this stage is not entitled to bail, moreover, the offence of rape is not only an onslaught on an individual person but on the whole society at large. With these observations Court rejected bail application. JNF |
