HC orders closure of brick kilns within 8 kms of airport | | | Early Times Report SRINAGAR, Dec 24: Jammu and Kashmir High Court on Tuesday directed authorities to ensure that no brick kiln owners are allowed to operate its smoke furnace within eight kilometers from runway at Srinagar airport. Hearing a public interest litigation, a division bench of the court headed by Chief Justice Gita Mittal also directed Airport Authority of India to carry disability audit by February 26, the next date of hearing the PIL. The court modified its earlier order and it directed that the authorities shall ensure that no brick kiln is permitted to operate their furnace or undertake any activity whereby smoke is generated in any manner within 8 kilometers from runway of airport. "It is clarified that brick kiln owners may take any other activity as are required for their business other than the smoke generated activities," the division bench, also comprising Sindhu Sharma, said. The court directed authorities to ensure strict adherence of this order. "Authorities shall also ensure that no unregistered brick kiln owners are permitted to undertake any kind of activity," the court said. Regarding rehabilitation of the owners whose brick kilns have been closed, the court directed JK government to take a review and ensure that the matter is examined at the highest level Advocate Anil Bhan, representing AAI, submitted that the date for conducting disability audit could not be finalized. He said that matter would be taken up in right earnest and it shall be ensured that disability audit is completed by next date of hearing. The court allowed the prayer. On previous date of hearing, the court had observed that aspect regarding disability access of the airports in the erstwhile State of Jammu and Kashmir has been overlooked in the Public Interest Litigation. "Basic facilities as ambu lifts, tactile markings, toilets for those with special needs are not available," the division bench had said. "We direct the Airport Directors, Srinagar, Jammu as well as Leh and the Airport Authority of India to coordinate with "M/s Nipman Foundation" (who is assisting the issues relating to disability in another PIL) and cause a disability access audit of the three airports to be undertaken," the court said. Recommendation be obtained so that all the three airports are made completely accessible to the differently abled, the court had said. "The Airport Authority of India shall ensure that all measures as are essential for enabling access to the airports as well as aircrafts and all other facilities are provided at the airports," the court had ordered further. |
